In short
In the Valencian Community the buyer pays a purchase tax: on a resale home, 9% ITP since 1 June 2026 (Generalitat Law 5/2025); on a new home from a developer, 10% IVA (VAT) plus AJD (0.1% for a main home, otherwise 1.4%). The bank pays the notary, land registry and gestoría for the mortgage and the AJD on the mortgage deed; you pay the valuation (tasación). Rates checked against the BOE and the Agència Tributària Valenciana on 29.10.2026.
Purchase taxes and costs are not covered by the mortgage or by the IVF and ICO guarantees: they come from your own money.

- ITP and AJD are declared on form 600 with the Agència Tributària Valenciana (ATV).
- Notary and registry fees are set by the state, but the amount depends on the price and the deed: ask the notary for an estimate in advance.

Resale homes: ITP
* The relief applies to the share bought by the young buyer if the sum of the general and savings income tax bases does not exceed €30,000 for an individual return or €47,000 for a joint one (Law 13/1997, art. 13). Similar 6% and 8% rates apply to general-regime protected housing (VPO) as a first main home.
| Case | Rate |
|---|---|
| General rate (from 1 Jun 2026) | 9% |
| Value above €1,000,000 | 11% |
| First main home of a buyer under 35, value up to €180,000* | 6% |
| Same, value above €180,000* | 8% |
New homes: VAT and AJD
- IVA (VAT) — 10% of the home price (Law 37/1992, art. 91). Paid to the developer instead of ITP.
- AJD on the sale deed — 0.1% if you buy your main home (vivienda habitual); otherwise 1.4% (Law 13/1997, art. 14).
Who pays the mortgage costs
- The bank: notary, registration and gestoría for the mortgage (Law 5/2019, art. 14) and the AJD tax on the mortgage deed, which is paid by the lender.
- You: the valuation (tasación) and any copies you request.
Costs of the purchase deed
Under the Civil Code (art. 1455), unless agreed otherwise, the seller pays for executing the deed before the notary, and the buyer pays for the first copy and everything after the sale, including registration. Notary and registry fees are set by the state; the notary and registrar give the exact amount. The municipal land value tax (plusvalía municipal) on a sale is paid by the seller (Local Finance Law, art. 106). A gestoría for the purchase is optional.
If the seller is a non-resident
- The buyer withholds 3% of the price and pays it to the tax office on the seller’s behalf (Non-Resident Income Tax Law, art. 25.2).
- If the seller is a non-resident individual, the law makes the buyer pay the plusvalía municipal in their place (Local Finance Law, art. 106.2). Factor this into the settlement with the seller.
Worked example
Formula: own funds = (price − mortgage) + purchase tax + valuation + notary and registration of the sale.
Resale home at €200,000 with an 80% mortgage: €40,000 deposit + 9% ITP = €18,000. Total €58,000 plus valuation, notary and registration as invoiced.
Same home, buyer under 35 with a 100% IVF-guaranteed mortgage and income within the limit: no deposit, ITP 8% (value above €180,000) = €16,000. Total €16,000 plus valuation, notary and registration.
New home at €200,000 as your main residence: 10% VAT = €20,000 + 0.1% AJD = €200.
